Summary:The need to provide ten percent of open space is a policy requirement of the policy to be followed by any landowner or developer who wants to develop their land. The issue of development of open space to other land use such as commercial, residential and industrial land owner or developer is often a hot issue because of the development undertaken is not specified in the given approval by the Local Authority. Such development is gaining attention because of the difficulties in acquiring the land or lack of the land for development in urban areas. This tendency increased within the higher areas of land to be obtained either through sale and purchase of land or land acquisition. Incidents such as this are already in conflict with the original purpose of providing open space which is established for public use only. Therefore, this study attempt to identify the factors considered in the creation of open spaces in terms of planning and land administration in the district of Pontian. In addition, this study also observed the gazetting of open spaces which have been adopted in the District of Pontian. The findings of the study, related that Pontian District Land Office in issue a regulation or circular in speeding up the process of gazetting of open spaces for the existing develop other land use will not work. So, it is hoped that this study will benefits and will also expose the parties involved in order to curb the problem existing open spaces. The purpose of providing open space should be adhering to the purpose of open space in accordance with the development as approval was granted by the Local Authority.
