This research aims to elucidate the legality of armed resistance against land occupation in Islamic law and international law. The researcher hypothetically assumes that the legitimate armed resistance is an actual tool in the hands of any people subjected to the occupation at any time; in the past or at the present time. This study holds great importance as a result of a mistakenly mix up of the meaning of the legitimate resistance with the concept of terrorism which is forbidden in the Islamic law as well as in the international law. The research adopts inductive, analytical and comparative study methodology; Information will be collected from their sources, analyzed and cited as evidence by putting them in their respective places. Legal evidences from the Qur’an, Sunnah and principles of international law are among the facts and evidences provided to clarify and strengthen the objectives of the research. The research presents examples of resistance against tyranny, invasion and occupation in the past and at the present time. The meaning and definition of resistance has been given linguistically and idiomatically explained, Its inception is disscused and some examples of resistances are given, and similar movements were also discussed followed by explain the legitimacy of resistance, its legal rule and the ilegitimate movements in the Islamic law and international law and their similarities and disimilarities.The research explains the conepts of terrorism phenomenon, its legal ruling in the Islamic law and international law, finding its causes and motives, and differentiating between terrorism and the legitimate armed resistance. The research also explains and clarifies the rights of prisoners of war and resistance, it also defines a prisoner of war, the legal ruling of having prisions of war and its legitimacy in the Islamic law and international law. The research discusses the application of international law on Iraq, as an example, and the extent of commitment of states in appling its rules and the international legal resolutions . This research came up with several important findings, including; the legality of armed resistance in the Islamic law and international law against tyranny, invasion and occupation for all the nations, and the prohibition of terrorism in all its forms and manifestations, the legality of prisoners of war’s and legitimate armed resistance’s rights and lack of commitment from states in the application of the international law rules and international legal resolutions. 2015-07-06T02:19:01Z 2015-07-06T02:19:01Z 2011 Thesis http://ddms.usim.edu.my/handle/123456789/8628 ar Universiti Sains Islam Malaysia |
