Summary:The right of victims and the accused persons for the expeditious disposal of criminal cases is provided to every citizen of Pakistan. However, this is easier said than done. In reality, Pakistani judiciary faces the most daunting challenges to ensure that cases they handled are expeditiously disposed. Currently, the inordinate delay in the Pakistani judiciary in the disposal of criminal cases is not much in consistence with international documents, treaties, conventions, and Islamic law as well. Inordinate delay in determining and hearing of criminal cases undermines the public’s trust in the judiciary. This unending and ongoing delay of pending cases is exacerbated by having more new cases as the population increases. This paper analyses the relevant laws and decided cases that illustrate delay in the disposal of criminal cases which amount to the violation of the rights of victims, accused persons, witnesses and those immediately related to them.
