Summary:Marriage is one of the religious requirements that celebrates the inherent tendency of human beings to live in pairs. It is also something that is supported by the Quran and hadith, and the bond between husband and wife is regarded to be a blessing and a symbol of excellence. The Word of Allah S.W.T: ''And among the signs of His power is He created for you wives of your own kind, so that you feel at peace with him, and he made it among you feel love and affection Indeed in such a way it is true there are signs for people who think". In sharia, nikah refers to a marriage performed in accordance with Islamic sharia principles, including the criteria and processes set in the Islamic religion. Marriage is a beautiful deed in Islam and a significant part of Muslims' lives. Marriages done according to Sharia principles in Malaysia are governed by the Act 1976 (Act 164), which governs all aspects of marriage, including related circumstances and processes. The Concept of Marriage According to Fiqh and Islamic Law is referred to as al-nikah in Arabic, which has numerous literal meanings. It means united (al-dhamm) and linked (aljam'), and it indicates the union and fusion of two or more entities. It is also a term for sexual intercourse (al-wati’) or real sexual intercourse (al-tadakhul). Marriage, according to fiqh, is a type of contract that can legalise the relationship between a man and a woman to have fun or make love under certain norms and circumstances and utilize the pronunciation of inkah, tazwij, or the translation of the two words. This definition refers to the marriage contract that connects a man and a woman and allows each pair to take advantage of the other couple's partner by making love to each other in order to attain mutual pleasure. Marriage in Islamic law is a civil contract that can take place with or without a ceremony. Marriage is legally performed when one party makes an offer and the other party accepts. Because it is based on ijab and qabul between the persons involved, marriage in Islam is more of a civil contract than a religious ritual. However, the Quran and Sunnah strongly advise against it, and the bond between husband and wife is one of the blessings and manifestations of God's magnificence to mankind (Ismail et al., 2022).
